Fifth Circuit Court of Appeals – Case of First Impression. In a landmark ruling drawing widespread attention across the national bankruptcy bar, Ben successfully argued before the Fifth Circuit on behalf of a creditor that had provided substantial funding to a company shortly before its bankruptcy filing. The court reversed the bankruptcy court and held that certain debts cannot be discharged in bankruptcy; even for corporate Subchapter V debtors. The decision has since become a frequently cited authority in developing Subchapter V jurisprudence and has prompted parallel litigation nationwide.
HMH Construction – MCA Litigation Defense. Ben secured a decisive ruling for a financial services company that had advanced substantial capital to a business, with the court holding that usury cannot serve as a basis for a claim against the lender; delivering a significant and precedential win for the defense.
Smile with Heart – Chapter 11 Conversion and Fiduciary Appointment.
Representing a creditor owed over one million dollars, Ben uncovered serious misconduct by the debtor, including diversion of revenue through affiliated entities, false statements under oath, and unauthorized use of company funds. He successfully moved to convert the Chapter 11 case and appoint an independent fiduciary, placing the company into liquidation and authorizing a full investigation into the fraud.
Pam Brandes – Protecting a Widow from a Predatory Creditor. In a case that exemplifies Ben’s commitment to fighting for individuals in vulnerable circumstances, he represented a widow whose former attorney—subsequently disbarred—had steered her into a predatory litigation funding arrangement from which she never actually received the promised funds. By filing bankruptcy before the judgment could attach as a lien on her home, Ben confirmed a plan that protected her homestead entirely and allowed her to resolve the debt for a fraction of the claimed amount—preserving not just her home, but her dignity.
NYAC – Bad-Faith Bankruptcy Dismissed with Sanctions. Ben represented two principals of a real estate company and successfully moved to dismiss a bankruptcy case that had been filed without authority by an individual who had already been stripped of control by court order due to fraudulent conduct. The court agreed the filing was improper, dismissed the case, and awarded sanctions against both the individual and his counsel.
