Coordinated Divorce Guidance for Property, Finances, & Parenting
Divorce can require simultaneous decisions about parenting arrangements, support, property, debt, and the marital home. We represent Queens residents in contested and uncontested divorce proceedings, building strategies around their immediate priorities and the financial and family issues connected to the marriage.
Our attorneys handle divorce and family-law matters alongside real estate, bankruptcy, foreclosure, estate planning, and litigation. This broader perspective can be valuable when a matrimonial action involves a mortgage, business interest, substantial debt, or dispute over financial disclosure.
Early legal review can identify records needed to classify, trace, or value assets and debts. It can also clarify the potential consequences of moving out, transferring property, withdrawing funds, signing an agreement, or responding to court papers. Matthew Routh represents families in custody, support, and divorce matters across Queens and Brooklyn. Dustin Bowman has more than a decade of experience in family and matrimonial law.
Divorce Representation Focused on What Is at Stake
We advise clients on equitable distribution, separation agreements, child custody and parenting time, child support, spousal maintenance, relocation, protection orders, and matrimonial appeals.
Contested & Uncontested Divorce in New York
An uncontested divorce generally means both spouses agree on every material term required for a judgment. A contested divorce involves disagreement over at least one issue, such as custody, support, maintenance, property, or debt.
Even a proposed uncontested settlement deserves careful legal review. The agreement may need to address parenting schedules, real estate, retirement accounts, taxes, insurance, payment deadlines, and enforcement if either spouse doesn’t comply.
How the New York Divorce Process Works
A New York Supreme Court matrimonial action begins with the purchase of an index number and the filing of either a summons with notice or a summons and verified complaint. The other spouse must then receive personal service in accordance with New York requirements.
Later stages may include financial disclosure, requests for temporary relief, court conferences, negotiation, divorce mediation, motions, and trial preparation. The sequence and timing depend on the disputed issues, the court’s schedule, and whether the spouses reach a complete settlement.
New York Grounds & Residency Requirements
New York law recognizes an irretrievable breakdown of the marriage lasting at least six months, along with other statutory grounds. Residency is a separate requirement. State law provides a two-year basis and several qualifying one-year alternatives, so we review where the spouses lived, where the marriage occurred, and other relevant connections before advising on filing eligibility.

Dividing Property and Debt and Addressing Maintenance
Equitable distribution is New York’s process for dividing marital property fairly under statutory factors, rather than automatically dividing everything equally. Financial review may cover the marital home, mortgages, bank accounts, retirement assets, business interests, personal property, credit obligations, and claims that an asset is separate property.
Spousal maintenance may also be part of the case. The analysis can involve income, resources, earning capacity, health, the length of the marriage, and other circumstances. Our work in real estate and financially complex disputes informs our review of proposed terms involving ownership, debt obligations, and future responsibilities.
Resolving Child Custody, Parenting Time, & Support
Custody decisions focus on the child’s best interests and may address legal decision-making, physical residence, parenting time, communication, and relocation. Child support is distinct from custody, although both may need to be resolved as part of the same divorce plan.
Safety concerns, domestic violence allegations, substance misuse, or intense parental conflict can affect the relief requested. We also handle protection orders and requests to enforce or modify family-law orders when circumstances warrant further court action.
How We Approach Divorce Representation
We begin by identifying your goals, urgent concerns, disputed issues, available records, and need for temporary relief. Our attorneys provide direct attention and clear communication as financial information, settlement proposals, and court orders shape the case. We pursue negotiated resolutions when appropriate and prepare for litigation when material disputes remain.
Where Queens Divorce Proceedings Are Handled
Queens Supreme Court’s Civil Term handles divorce actions through its matrimonial department. Depending on whether a divorce is pending and the relief requested, related custody, visitation, and support proceedings may also involve Queens Family Court.
Court forms offer procedural direction, but they don’t evaluate evidence, proposed settlement terms, or the consequences of a filing decision. We assess the proper court and legal strategy based on existing proceedings, the requested relief, and the facts of the case.
How to Prepare for a Divorce Consultation
Be prepared to discuss the date and place of your marriage, current living arrangements, children’s schedules, income, property, debt, prior agreements, and any court papers. Bring available account statements, tax returns, mortgage records, and proposed agreements when those documents relate to the dispute.
Tell us at the outset about deadlines, safety concerns, threatened asset transfers, or immediate parenting problems. This allows us to distinguish issues requiring prompt attention from those that can be addressed through negotiation or longer-term planning.

Related & Post-Judgment Matrimonial Matters
A divorce case doesn’t always end when the judgment is entered. We handle separation agreements, order enforcement and modification, relocation disputes, protection orders, and matrimonial appeals.
The proper procedure depends on the existing agreement, order, or judgment, as well as any changed circumstances and the relief requested. We review the controlling documents and court history before recommending how to proceed.
Get Clear Direction Before Your Next Divorce Decision
Consider speaking with a divorce attorney before filing, after receiving court papers, or before accepting proposed terms. We can assess unresolved questions involving children, support, property, debt, housing, or financial disclosure and explain the potential next steps.
